This Affiliate Program Terms of Service (ToS) Agreement (the “Agreement”) sets forth the obligations and conditions between you (“Client”, "You") and GoLogin LLC ("GoLogin", the “Provider”), relating to your use of the Serviced defined herein. Please read this Agreement carefully. Your use of the Services is expressly conditioned on your acceptance of this Agreement.
Recitals
GoLogin LLC may change these Affiliate Program Terms of Service at any time without notice, effective upon their posting. Client's continued participation in the Affiliate Program shall be considered Client's acceptance of the revised Terms of Use. If Client does not agree to these Terms of Use, Client shall discontinue participation in the Affiliate Program.
By taking part in the Affiliate Program (generating or using Affiliate Links, receiving rewards, submitting reward withdrawal requests, and so forth), the Client confirms that Client has read, understood and agrees to be bound by the following Terms:
Terms of Service
By participating in the Affiliate Program, You acknowledge your understanding that affiliate marketing is the process by which an affiliate earns a commission for marketing another person’s or company’s products. In that sense, You confirm your understanding that while participating in GoLogin‘s Affiliate Program, You would be considered an Affiliate and You would be marketing GoLogin‘s services.
The main goal in an Affiliate Program is to promote GoLogin and to attract new users of GoLogin (the “New Users”).
While logged into your GoLogin Account, You can generate a default Affiliate Link or create a custom Affiliate Link.
A default Affiliate Link is generated automatically.
Custom Affiliate Links are generated using a custom name indicated by You.
The length of the custom name may be limited for technical reasons.
The custom name shall not in any way violate applicable laws, rules, other person’s rights (for example, You are not allowed to use wording that violated IP rights of any other person or entity), as well as generally accepted rules of good morals.
GoLogin may provide any other material/data, both specially generated for You, or used as a general marketing material. You shall always use such material in accordance with the instructions provided by GoLogin.
The Client participating in the Affiliate Program shall use the affiliate links, and/or any other affiliate materials, for promotional purposes. The Affiliate Program materials can be shared and published by the Client in order to attract New Users at the discretion of the Client, provided they obey the rules set in this Agreement.
The Client acknowledges and agrees that the Client is solely responsible for the way the Client uses affiliate material. GoLogin does not control nor impact in any way actions of the Client, therefore GoLogin shall not be liable for any harm such actions may cause.
The Client shall always make sure that sharing or publishing affiliate materials are in accordance with applicable laws, rules and generally accepted rules of good morals, and that such action does not violate other persons’/entities’ rights. The Client shall not share/publish the affiliate materials in any paid channels, unless otherwise agreed between the Client and GoLogin.
GoLogin believes that the honest marketing model and fair market competition should always be a priority and encourages Client to always make sure their actions are in accordance with those principles.
The Client acknowledges and agrees that the actions in paragraph 5 are strictly forbidden and constitutes a material breach of the Agreement. The provided list is non-finite and includes only the most common unfair and prohibited practices.
It is prohibited to use the GoLogin Affiliate Program in, but not limited to, the following ways:
To use fraud in order to gain any material benefit (for example: to use stolen credit cards to generate revenue with intent to gain reward).
Place Affiliate Links on any website containing unlawful, illegal, harmful, ethically unacceptable content
To use Affiliate materials in GoLogin’s competitor’s communication channels (for example: Telegram groups, Reddit, Discord, webforums, etc).
To engage in unfair, aggressive or misleading practices, including but not limited to, creating and using fake accounts, spamming, harassing or bullying New Users into using Services, pressuring with false “limited offer” campaigns, giving false information or leaving important information out, etc.
To provide false information about applicable fees, promotions, discounts or features of the Services, as well as to falsely offer prizes or gifts.
To present Yourself as being a representative of GoLogin or GoLogin itself.
To engage children, including asking/encouraging them to promote the Services in any way (for example, to share the affiliate materials or to ask for their parents, legal guardians or any other person to order Services for them).
To use fraudulent or deceptive design patterns that are created in order to encourage, deceive or steer the user to take a certain action (for example: creating a sense of urgency by using fake countdown timers).
To camouflage affiliate materials in such a way that it is not obvious that they are materials for the purpose of marketing GoLogin (for example, by putting affiliate material into a game and making it seem like a part of that game).
To create fake consumer reviews or promote any advantages as special when the person already has those rights as per applicable law.
To create pyramid schemes.
Use your Affiliate Link to purchase GoLogin subscriptions for yourself or anyone else.
Bid on keywords and phrases containing the “GoLogin” trademark, or variations or misspelling of the trademarked term on Pay-per-Click or Pay-per-Impression campaigns on search engines (such as Google, Yahoo, MSN, Ask, Bing or others) without prior written approval from GoLogin.
To use the GoLogin Website(s) as display URL in Paid media ads and to direct-link or redirect to the GoLogin Website(s).
To use the Affiliate Program, Your Affiliate Link and/or the GoLogin brand in general in any way, other than for their original intended purpose of promoting GoLogin’s services, including, but not limited to,
using Black Hat SEO techniques,
using pay-per-click to redirect or manipulate traffic,
other similar means
Any illegal and/or fraudulent activity with intent to gain material or monetary benefit, both resultative or not, as well as any attempt to act in an illegal or fraudulent manner shall constitute a material breach of the Agreement, alongside with potential notification of the activity to the responsible law enforcement authorities and a lifetime ban on using GoLogin in any capacity.
In case of a breach of the Agreement:
The Client acknowledges and agrees that GoLogin shall have a right to refuse to proceed with the withdrawal of the rewards, meaning the Client might lose its right to receive the reward (commission, earnings) in part or in full.
GoLogin shall have a right to unilaterally, at its own discretion, decide whether to proceed with the withdrawal or not, and in what scope, based on the nature of the violation conducted by the Client.
GoLogin reserves the right to ban the Client from taking part in the Affiliate Program unilaterally, at its own discretion, for any breach of the Agreement.
GoLogin reserves the right to discontinue any communication with Client unilaterally.
The Client participating in the Affiliate Program is entitled to receive a reward that is set at the sole discretion of GoLogin.
The standard reward is 30% of the first payment a New User makes on their subscription, followed by 10% of every subsequent payment the New User makes over the lifetime of the subscription.
GoLogin reserves the right to alter the rewards, at GoLogin’s discretion, without prior notice.
The Client is only entitled to receive rewards for New Users when the New User has made at least 2 (two) payments.
If the New User requests and receives a refund for their payment(s), the corresponding reward(s) the Client would otherwise receive for said payment(s) shall also be nullified and removed from the Client's Affiliate Program payout list.
The Client shall have a right to withdraw his/her rewards using tools available at section “Affiliate Program” in the GoLogin app while logged into their Account.
GoLogin shall fulfill Client’s reward withdrawal requests within thirty (30) calendar days of a complete and valid withdrawal request being made by Client.
Incomplete or invalid requests, (for example, those which do not allow the successful transfer of funds, which do not include all required information, or which do not comply with some section of the Agreement) are not considered valid by the Agreement.
Client will be made aware that their request is invalid by GoLogin, but GoLogin shall not be held responsible for fulfillment of such request.
The GoLogin app allows logged-in users to see the following information:
Total reward (commission) amount.
Unpaid reward (commission) amount.
Total number of New users that are linked to the Client participating in the Affiliate Program.
Clicks, conversion and earning statistics for each affiliate link.
GoLogin retains the right to change the dashboard and data shown to the Client participating in the Affiliate Program at GoLogin’s discretion without prior notice.
